The following terms and conditions of sale regulate the sale of goods on the solartitalia.it website. Your use of the website to purchase merchandise indicates your agreement to follow, and be bound by, these Terms and Conditions of Sale.

1. PRODUCTS AND ORDERS

Product availability is indicated on the product detail page. There are different levels of availability:

Product available: you can order it and it will soon be shipped to your home.

Product not available because the product is not in stock: if you want to be informed when it is available, enter your e-mail address to be notified when the product returns to the catalogue, many products are unique pieces and therefore cannot be purchased again.

All orders are subject to email confirmation from the SOLART company. Please note that products on the site may be discontinued, and availability is not guaranteed. We have tried to optimize the display of the colors of our products but, nevertheless, the colors you see may vary depending on your monitors and may not be accurate.

The measurements included in the description are approximate and therefore may have a minimum of fluctuation.

2. PRICES

All prices are in euros. The prices may change without notice.

3. SHIPPING COSTS

You are responsible for transportation costs associated with the delivery of products purchased on the site as specified in the order confirmation.

4. SHIPPING AND DELIVERY

Delivery is considered complete and possession of the product passes to you upon acceptance of the shipment by the carrier.

5. RETURNS AND REFUNDS

Please refer to our returns policy, which forms an integral part of these General Conditions of Sale.

6. BINDING AGREEMENT

The order confirmation by SOLART, these terms and conditions of sale and the other policies of the site, are the definitive agreement between you and SOLART regarding the matters contained in these General Conditions of Sale.

7. APPLICABLE LAW AND CHOICE OF COURT

The laws in force in Italy govern all matters arising out of, or in connection with, these terms and conditions of sale, including, without limitation, their validity, interpretation, construction, performance and application. All legal proceedings arising out of, or about, these Terms and Conditions of Sale shall be brought exclusively in the city of Trapani, Italy.

8. DISCLAIMERS AND LIMITATIONS OF LIABILITY

There are no implicit or explicit guarantees other than what is established in the confirmation of the goods contained in the order by SOLART.

SOLART will not be responsible for damages of any kind arising from the use of the site. This includes (but is not limited to) direct, indirect, incidental, punitive and consequential damages.

Some states have laws that do not allow limitations on implied warranties or the exclusion of certain damages. If these laws apply to you, some or all of the above liabilities, exclusions, or limitations may not apply to you, and you may have additional rights.

9. SEVERABILITY

If any provision of these General Terms and Conditions of Sale is held to be invalid, illegal or unenforceable, the remaining provisions of these terms and conditions of sale will remain in full force, to the extent permitted by law.

10. PRIVACY

The privacy terms and conditions govern the processing of all personal data collected for the purchase of products via the website.

11. FORCE MAJEURE CAUSES

SOLART shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.

RETURN POLICY

The customer has the right to withdraw from the contract, without indicating the reasons, within 14 days, without any penalty, in accordance with the legal provisions in force, pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.

In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14 day period starts from the date of receipt of the last product.

To exercise the right of withdrawal, it is necessary to inform Solart Italia, Res. Andromeda 141, Milano 2 (MI) ITALY, of the decision to withdraw from this contract via any explicit declaration to michele@solartitalia.com

Following withdrawal from this contract, Solart Italia will refund all payments made by the buyer without undue delay and in any case no later than 14 days, from the day on which Solart Italia is informed by the customer of the decision to exercise the right of withdrawal.

These refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed.

The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his desire to withdraw from the sales contract.

Customers are informed that any customs duties and import taxes are the responsibility of the customer. The relevant amount is to be paid to the courier according to the methods that will be indicated by the courier itself.

If customs duties/charges are found, the package will NOT be accepted and will be rejected (blocked at customs or sent back with any additional costs always borne by the sender).

The Products must be returned:

- correctly packaged in their original packaging, not ruined, damaged or dirty and equipped with all accessories, instructions for use and documentation;

- equipped with the transport document (present in the original packaging), so as to allow Solart Italia to identify the customer (Order number, name, surname and address);

- without obvious signs of use, other than those compatible with carrying out a normal test of the article (they must not show traces of prolonged use or in any case exceeding the time necessary for a test and must not be in such a state as not to allow resale).

If the returned product does not comply with the provisions of the previous paragraph, the withdrawal will not be effective.

Within 7 working days of receiving the goods, the amount will be credited back with the same payment method used at the time of purchase if possible (Credit Card on the website, PayPal).

COURIER

It is possible to send your return by courier or other shipping methods. You must send the return at your own expense, using a courier of your choice. We are not responsible for any loss or damage to returned items.

EXCHANGES

We do not offer any exchange on goods purchased on the site.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

SOLART does not provide explicit or implicit representations or guarantees on the products on the website, nor on the goods on sale.

To the fullest extent permitted by law, SOLART disclaims all warranties, express or implied. This includes (but is not limited to) warranties of merchantability, fitness for a particular purpose and non-infringement.

There are no implicit or express warranties on the part of SOLART other than what is set out in the order confirmation for the goods ordered.

SOLART will not be liable for damages of any kind (direct, indirect, punitive and consequential) arising from the use of the site.

SHIPPING

The shipping cost is automatically calculated based on the total weight of the products ordered. You can see the exact shipping cost before completing the order.

1. DELIVERY TIMES

Depending on product availability, SOLART guarantees that your order will leave the warehouse as quickly as possible - from a minimum of 12 hours to a maximum of 7 working days.

How is it calculated?

Along with product availability, we also need to take into account the time it takes to process an order. Orders placed via online payment (credit card and PayPal) with Express Courier delivery have the fastest processing and delivery time.

Types of payment methods and delivery methods may affect the shipping time. For example, orders with deferred payment (such as bank transfer) may affect the shipping date by a couple of days, as they are processed upon receipt of payment confirmation.

Once you have placed your order and selected your payment method and delivery method, the goods are given to the courier for delivery to your home.

2. SHIPPING COSTS

Deliveries by courier to the rest of the world will be charged a flat rate of €20.00.

If there is a delay in the delivery of your goods we will contact you promptly. If the goods are not delivered within 20 days it is possible to request cancellation of the order and subsequent refund.

3. DELIVERY TIPS

- If you are not present when the courier arrives, the courier will leave a notice of attempted delivery. Please contact the courier to arrange another delivery date.

If this does not work, SOLART will be notified by the courier.

There will then be a notification via e-mail that the package will be found in the courier's warehouse. Here it will remain for a maximum of 10 days.

After that, it will be automatically returned to SOLART.

- Check that the correct number of packages is indicated on the transport document.

- Check that the packaging is intact and unaltered (this includes the sealing or closing strips).

- Before signing for the delivery, write, "subject to goods inspection due for (tampering, breakage, damage, etc.)" if you notice something wrong with the condition of your package.

- Report any damage within 7 (seven) days of receiving the goods.

4. DELAY OR FAILURE TO DELIVER THE PURCHASED PRODUCT

Before activating the procedure described below, it is advisable to check the package using the online tracking received on your e-mail address at the time of shipment and contact the relevant courier for further details and information.

In case of delay or non-delivery of the purchased product more than 20 days, it is possible to cancel the order by sending a request to michele@solartitalia.com. The communication can also be sent via fax to the number +39 0924 501002, at your discretion. we will contact via phone within the next 48 hours.

Once the request has been received and the various appropriate checks have been carried out, within 30 days, the Seller will refund the price of the products purchased.
